[시론] 보완수사권 유지, 누구를 위한 것인가

최근 한국 정치권에서는 검찰의 보완수사권 폐지를 둘러싼 논쟁이 거세다. 보완수사권을 유지해야 한다는 측은 “피해자 보호를 위해 반드시 필요한 제도”라고 주장한다. 반대로 폐지를 주장하는 측은 검찰권 남용의 역사를 더 이상 반복해서는 안 된다고 말한다. 양측 모두 나름의 논리를 내세우고 있다. 그러나 이 논쟁에서 가장 먼저 던져야 할 질문은 따로 있다.

검찰은 그동안 자신에게 주어진 권한을 국민이 신뢰할 만큼 공정하게 행사해 왔는가.

보완수사권은 분명 사건의 미비점을 보완하고 진실을 밝히기 위한 제도다. 피해자를 보호하고 부실수사를 막는 순기능도 있다. 하지만 제도의 취지만으로 권한의 정당성이 보장되는 것은 아니다. 문제는 권한의 존재가 아니라, 그 권한이 어떻게 행사되어 왔는지에 있다.

한국 사회가 검찰개혁을 논의하게 된 이유는 단순히 검찰이 강한 권한을 가졌기 때문이 아니다. 선택적 수사, 선택적 기소, 별건수사, 과잉수사, 정치적 사건에 대한 형평성 논란 등 오랜 시간 누적된 불신이 그 출발점이었다. 국민은 “왜 어떤 사건은 끝까지 파헤치고, 어떤 사건은 조용히 덮이는가”라는 의문을 반복해서 제기해 왔다.

검찰이 직접 수사할 수 있는 권한이 많을수록 정의가 실현된다는 보장은 없다. 권한은 언제나 공정성과 책임이라는 원칙 위에서만 정당성을 얻는다. 아무리 좋은 제도라도 견제 장치가 부족하면 권한은 남용될 가능성을 안고 있다. 이는 검찰뿐 아니라 경찰, 행정부, 국회, 사법부 등 모든 국가기관에 동일하게 적용되는 민주주의의 기본 원칙이다.

일각에서는 보완수사권 폐지가 결국 피해자를 더 힘들게 만들 것이라고 우려한다. 충분히 귀 기울일 주장이다. 그러나 피해자 보호가 곧 검찰의 보완수사권 유지를 의미하는 것은 아니다. 피해자를 보호하는 가장 좋은 방법은 특정 기관에 권한을 집중시키는 것이 아니라, 국가수사본부와 곧 출범할 중대범죄수사청(중수청) 등 수사기관이 상호 견제와 협력을 이루고, 그 수사권을 감시하는 제도적 장치를 통해 어느 기관이든 공정하고 신속하며 책임 있게 수사하도록 만드는 것이다.

오랫동안 검찰권의 선택적 행사로 상처받았다고 느끼는 국민도 적지 않다. 수사가 정치적 이해관계에 따라 속도가 달라졌다는 의혹, 사회적 지위에 따라 잣대가 달라졌다는 비판은 반복되어 왔다. 이러한 경험이 쌓이면서 검찰에 대한 국민의 신뢰는 크게 흔들렸다. 이러한 현실을 외면한 채 보완수사권만을 피해자 보호의 상징처럼 이야기하는 것은 논의의 절반만 보는 것일 수 있다.

결국 보완수사권 존치 여부보다 더 중요한 것은 수사와 기소, 그리고 이를 감시하고 통제하는 법적 장치를 통해 각 기관이 국민의 신뢰를 회복할 수 있는 구조를 만드는 일이다. 권한은 클수록 더욱 강한 책임과 투명성이 따라야 한다. 민주주의 사회에서 어떤 기관도 견제받지 않는 권한을 가져서는 안 된다.

권한은 스스로를 정당화하지 못한다. 국민의 신뢰만이 권한에 정당성을 부여한다. 법치주의가 지켜야 할 것은 권력의 확대가 아니라 권력의 절제와 견제다.

What South Korea’s Debate Reveals About Democracy

When governments ask to keep a legal power, citizens usually ask one simple question:

Can we trust them to use it wisely?

That question lies at the heart of one of South Korea’s most important legal debates today.

South Korea is restructuring its criminal justice system by separating investigation from prosecution. Under the proposed system, most criminal investigations would be handled by independent investigative agencies, while prosecutors would focus primarily on deciding whether to bring charges. The remaining question is whether prosecutors should still retain supplementary investigation powers—the limited authority to request or conduct additional investigative work when reviewing cases before indictment.

Supporters argue that this authority is necessary to correct investigative gaps, strengthen weak cases, and better protect victims. Opponents see the issue differently. They argue that South Korea’s history of selective investigations and allegations of prosecutorial overreach have weakened public trust. From that perspective, even a limited investigative power could eventually be expanded or abused. Their conclusion is simple: if public confidence has already been damaged, that authority should not remain with prosecutors.

The debate therefore goes beyond one legal provision. It asks whether institutions that have lost public trust should continue to exercise even limited investigative authority. The issue is no longer simply what prosecutors are allowed to do, but how much confidence citizens still have in the institution itself.

Protecting victims remains an essential goal. Yet many legal scholars argue that victim protection does not depend solely on prosecutors retaining supplementary investigation powers. It can also be achieved through thorough investigations by independent agencies, effective cooperation between institutions, and strong legal oversight that ensures investigations remain fair, accountable, and transparent.

Ultimately, this is not only a South Korean question. Democracies everywhere must decide how to balance effective law enforcement with institutional accountability. The challenge is not merely determining which powers should exist, but deciding which institutions the public is willing to trust with those powers.

Power is never sustained by law alone. In a democracy, its strongest foundation is public trust.
