다음은 러시아에서 불심검문과 관련된 뉴스입니다. 한 때 러시아 대륙횡단 열차를 타고 하바로프스크에서 이르쿠츠크를 거쳐 모스크바에 도착해 유럽을 여행하는 꿈을 꾸었는데, 아직까지 실현되지 못했습니다. 모든 게 여의치 않으니 이제는 꿈을 깨야 할 것 같습니다.

경찰의 불심검문
- 경찰이 범죄혐의가 있는 대상자에 대해 신체수색 및 소지품 검사, 차량 검문 등을 하는 행위
- 가방의 내용물 확인 및 휴대폰 비밀번호를 풀게 한 뒤 휴대폰에 저장된 내용을 확인하는 것도 가능(러시아 헌법재판소 판결)
경찰관이 불심검문을 요청할 수 있는 경우
- 검문 대상자가 범죄를 저질렀다는 혐의가 있는 경우
- 검문 대상자가 지명수배 되었다는 혐의가 있는 경우
- 검문 대상자가 행정법 위반했다는 혐의가 있는 경우
- 검문 대상자가 체포 요건에 해당할 경우
불심검문 과정에서 행정위반법, 출입국법 등 각종 법령 위반으로 조서작성 등 추가 조사가 필요하다고 판단되는 경우 체포 후 경찰서로 인치할 수 있음
경찰서 인치 시 구금 가능 시간
- 행정위반 건 경우 – 3시간(행정위반법 제 27.5조 1항)
- 특수 건의 경우 – 48시간(행정위반법 제 27.5조 2-3항)
- 형사 건의 경우 – 48시간(형사법 제94호 2항)
- * 법원 판결로 추가 72시간 연장 가능(형사법 제108조 7(3)항)
불심검문 거부 시 처벌 조항
- 시민은 경찰관의 요청에 불응 시 러시아 연방 행정위반법 위반으로 처벌 가능

- 동행한 경찰관의 신분, 직위, 이름 등을 알려 달라고 요청할 권리
- 불심검문의 사유와 목적을 알 권리

Recently, there has been a growing number of cases where individuals in Russia have been subjected to police questioning, including inspections of personal belongings and mobile phones. In response to inquiries regarding the legality of such police activities, we provide below information on the relevant laws regarding police questioning and baggage inspection in Russia.
Police Questioning and Baggage Inspection:
- Police officers perform body searches, inspect personal belongings, conduct vehicle searches, and other related actions on individuals suspected of committing crimes.
- It is permissible to check the contents of bags and unlock mobile phones to review stored information, as determined by a decision of the Russian Constitutional Court.
Circumstances allowing police officers to request questioning and inspection:
- Individuals suspected of committing a crime.
- Individuals who have been issued an arrest warrant.
- Individuals suspected of violating administrative laws.
- Individuals meeting the requirements for arrest.
- Additional investigations and detention at the police station during the questioning process:
If deemed necessary due to violations of various laws, such as administrative law or immigration law, police officers may proceed with additional investigations, including the drafting of records, after the arrest.
Detention periods when taken to the police station:
- For administrative law violations: up to 3 hours (Article 27.5(1) of the Administrative Offenses Code).
- For special cases: up to 48 hours (Article 27.5(2-3) of the Administrative Offenses Code).
- For criminal cases: up to 48 hours (Article 94(2) of the Criminal Procedure Code).
- An additional extension of 72 hours is possible with a court order (Article 108(7)(3) of the Criminal Procedure Code).
Penalties for refusing police questioning:
- Citizens who refuse to comply with police requests may be subject to penalties for violating the Russian Federal Administrative Offenses Code.
- The penalties include fines ranging from 2,000 to 4,000 rubles or up to 15 days of detention.
Rights of citizens during police questioning:
- The right to request information about the accompanying officer’s identity, position, and name.
- The right to know the reasons and purpose of the police questioning.
- If the rights and freedoms of citizens are infringed upon during the questioning process, individuals have the right to request an explanation from the police regarding the reasons and purpose of the infringement, as well as an explanation of their rights and obligations.
